Please read these Terms and Conditions carefully before using the Muscle AI mobile application. By accessing or using the app, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account and using Muscle AI, you confirm that you:
- Are at least 13 years of age
- Have the legal capacity to enter into binding contracts
- Agree to comply with these Terms and all applicable laws
- Accept our Privacy Policy
If you do not agree with any part of these Terms, you must not use the app.
2. Service Description
Muscle AI provides AI-powered muscle analysis and fitness tracking services including:
- AI-based muscle development analysis from uploaded photos
- Progress tracking and historical analysis comparison
- Personalized workout recommendations
- Streak tracking and achievement system
- Subscription-based access to premium features
3. User Account
To use Muscle AI, you must create an account via Google OAuth. You agree to:
- Provide accurate and current information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
- Not share your account with others
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription Plans and Billing
Muscle AI offers three subscription tiers:
- Basic Plan: $4/month - 5 analyses per month
- Pro Plan: $7/month - 20 analyses per month
- VIP Plan: $14/month - 50 analyses per month
Subscription Terms:
- Billing is handled by Razorpay, our payment processor
- Subscriptions automatically renew monthly unless cancelled
- Monthly usage resets at the start of each billing cycle
- Unused analyses do not roll over to the next month
- Changes take effect at the next billing cycle
- All prices are in USD and subject to change with 30 days notice
5. Cancellation and Refunds
You may cancel your subscription at any time from the app's subscription management screen. Upon cancellation:
- You will lose access to the plan as soon as you cancel the subscription
- No refunds are provided for partial months
- Your analysis history remains accessible
- You can resubscribe at any time
We reserve the right to refuse refunds except as required by law or in cases of service failure on our part.
6. AI Analysis and Medical Disclaimer
IMPORTANT: Muscle AI is NOT a medical device and should NOT be used for medical diagnosis:
- Our AI analysis is for informational and fitness tracking purposes only
- Results are estimates and may not be 100% accurate
- Do not use our analysis to diagnose medical conditions
- Consult healthcare professionals before starting any fitness program
- We are not liable for injuries resulting from following recommendations
- Analysis accuracy depends on photo quality and consistency
7. User Content and Photos
When you upload photos to Muscle AI:
- You retain all rights to your photos
- You grant us a license to process, store, and analyze your photos
- You confirm you have the right to upload the photos
- You agree not to upload inappropriate, offensive, or illegal content
- You can delete your photos at any time
- We do not claim ownership of your content
8. Prohibited Uses
You agree NOT to:
- Use the app for any unlawful purpose
- Attempt to reverse engineer, decompile, or hack the app
- Upload malicious code or viruses
- Abuse the API or attempt to exceed usage limits
- Upload photos of other people without their consent
- Use the app to harass, abuse, or harm others
- Share or resell access to your account
- Scrape or collect data from the app using automated means
9. Intellectual Property
All content, features, and functionality of Muscle AI are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or distribute our software or content
- Use our trademarks or branding without permission
- Create derivative works based on our app
10. Service Availability
We strive to provide reliable service but cannot guarantee:
- Uninterrupted or error-free operation
- That defects will be corrected immediately
- Compatibility with all devices or operating systems
We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.
11. Limitation of Liability
To the maximum extent permitted by law, Muscle AI shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Injuries resulting from fitness activities
- Inaccurate AI analysis results
- Unauthorized access to your account
- Third-party service failures (Supabase, Razorpay, etc.)
Our total liability shall not exceed the amount you paid in the last 12 months.
12. Privacy Policy
Your use of Muscle AI is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.
13. Termination
We may terminate or suspend your account immediately, without notice, if you:
- Violate these Terms
- Engage in fraudulent activity
- Abuse the service or other users
Upon termination, your right to use the app ceases immediately. You may request account deletion at any time.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via:
- In-app notification
- Email to your registered address
- Updated "Last updated" date
Continued use of the app after changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
